These Terms & Conditions govern all sales and transactions by Kimes Steel & Rail, Inc. ("KSR"), located at 2 George Street, PO Box 330, New Haven, WV 25265. By placing an order, you agree to these terms.
All quotes are valid for 30 days unless otherwise stated. Prices are subject to change without notice. Orders are binding once confirmed by KSR in writing or via email.
Payment terms are Net 30 for approved credit accounts. New customers may be required to prepay or provide a credit application. A late payment fee of 1.5% per month may apply to overdue balances.
All shipments are FOB origin (New Haven, WV) unless otherwise agreed. KSR will arrange shipping upon request but is not responsible for carrier delays or damage in transit. Customers should inspect all deliveries upon receipt and report damage to the carrier immediately.
Returns are accepted within 30 days of delivery with prior authorization from KSR. Items must be in original, unused condition. Custom-fabricated or cut-to-length products are non-returnable. Refunds are processed within 5 business days of receiving the returned item. Return shipping costs are the responsibility of the buyer unless the return is due to a KSR error.
KSR warrants that products conform to applicable ASTM/AREMA specifications as described. KSR makes no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. KSR's liability is limited to the purchase price of the product.
KSR shall not be liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, labor disputes, supply chain disruptions, or government actions.
These terms are governed by the laws of the State of West Virginia. Any disputes shall be resolved in the courts of Mason County, West Virginia.
